Standard information form for package travel contracts

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code.
You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code. The Déesse voyages company will be entirely responsible for the proper execution of the package as a whole.
In addition, as required by law, the Déesse voyage company has protection to refund your payments and, if transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.

Essential rights under Directive (EU) 2015/2302 transposed into the Tourism Code:
Travelers will receive all essential information about the package before concluding the package travel contract.
The organizer as well as the retailer are responsible for the proper execution of all travel services included in the contract.
Travelers are provided with an emergency telephone number or point of contact to reach the organizer or retailer.
Travelers may transfer their package to another person, subject to reasonable notice and possible payment of additional fees.
The package price may only be increased if specific costs increase (e.g. fuel prices) and if this possibility is explicitly provided for in the contract, and in any case may not be changed less than twenty days before the start of the package. If the price increase exceeds 8% of the package price, the traveler may withdraw from the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction in the event of a reduction in the corresponding costs.
Travelers may cancel the contract without paying cancellation fees, and receive a full refund of payments made, if any essential element of the package, other than the price, undergoes a significant change. If, prior to the start of the package, the professional responsible for the package cancels it, travelers have the right to obtain a refund and compensation, if applicable.
Travelers may cancel the contract without paying a cancellation fee before the start of the package in the event of exceptional circumstances, for example if there are serious safety problems at the destination that are likely to affect the package.
In addition, travelers may cancel the contract at any time prior to the start of the package, subject to payment of an appropriate and justifiable cancellation fee.
If, after the start of the package, important elements of the package cannot be provided as planned, travelers must be offered appropriate alternative services at no extra charge. Travelers may withdraw from the contract without paying a withdrawal fee if the services are not performed in accordance with the contract, if this significantly disrupts the execution of the package and if the organizer fails to remedy the problem.
Travelers are also entitled to a price reduction and/or compensation in the event of non-performance or poor performance of travel services.
The organizer or retailer must provide assistance if the traveler is in difficulty.
If the organizer or retailer becomes insolvent, the amounts paid will be reimbursed. If the organizer or retailer becomes insolvent after the start of the package, and if transport is included in the package, repatriation of travellers is guaranteed. Déesse Voyages has taken out insolvency protection with GROUPAMA. Travelers may contact this entity (GROUPAMA 8-10 rue d'Astorg, 75008 Paris) if they are refused services due to the insolvency of Déesse Voyages.

GENERAL INFORMATION

The conditions governing the organization and sale of travel or tourist packages are governed by articles L. 211-1 et seq. and R. 211-1 et seq. of the French Tourism Code.

Designation of the seller

The present terms and conditions of sale are given to the customer before the booking contract is signed.

They concern services sold by DEESSE VOYAGES, a simplified joint stock company with a single shareholder, whose registered office is located at 674 chemin du moulin, 05230 Chorges, registered in the Trade and Companies Register under number 533 188 025, registered with Atout France as a holiday operator under number IM005110019.

CONTRACT FORMATION

1-Registration

The general conditions of our travels governing the relationship between travel agencies and their customers have been set in application of Ordinance n°2017-1717 of December 20, 2017 transposing Directive (EU) 2015/2302 of the European Parliament and of the Council of November 25, 2015 on package travel and related travel services, as well as by Decree no. 2017-1871 of December 29, 2017 taken for the application of Ordinance no. 2017-1717 of December 20, 2017 transposing Directive (EU) 2015/2302 of the European Parliament and of the Council of November 25, 2015 on package travel and related travel services. Booking one of our trips presented in our annual catalog or submitted by quotation implies acceptance of these general terms and conditions of sale, as well as the special conditions set out below. Details of the articles of the law are available on request.

By signing the contract, the customer acknowledges that he/she is of legal age and legally capable of entering into a contract and committing himself/herself for all the participants listed on the registration form. Persons under guardianship or trusteeship are obliged to state their situation when registering, and to provide written authorization from their trustee. Persons under guardianship may not enter into contracts on their own, and must travel with their guardian or a person authorized by the guardianship judge. DEESSE VOYAGES cannot be held responsible if one of the above conditions is not respected.

The reservation will only be confirmed after the return of the proposal drawn up by DÉESSE VOYAGES, signed by the Customer and the payment of the deposit and the remainder of the amount under the conditions defined in the article "Terms of payment".

2-Organization of the reservation

- Headcount: the Customer confirms in writing to DÉESSE VOYAGES the estimated headcount for the event, no later than the date of signature of the contract. This number of participants constitutes the basis for the application of cancellation and/or modification fees for all services ordered.

Increase or decrease in the number of participants before departure: the price will be revised upwards or downwards according to the actual number of participants, with reference to the commercial offer.

- Services: In case of necessity, when circumstances oblige us or for technical reasons, we reserve the right to take a different itinerary from the one planned, to reverse the program, to cancel or replace certain services, while respecting the content of the program. We reserve the right to make any changes deemed necessary for the smooth running of the trip and in the customer's interest, without being held responsible, as long as they do not constitute a change to an essential element of the contract and the services offered are equivalent, and which may not lead to a claim for compensation.

- Additional services: Any additional service requested by the customer prior to departure and after signature of the present contract, and accepted by the service provider, will be the subject of an amendment to the present contract. The cost of this additional service will be invoiced in addition to the agreed price and paid for in accordance with the terms and conditions set out in the article Terms and Conditions of Payment.

Should the service provider be unable to satisfy a request for an additional service, the customer shall not be entitled to call into question the commitments resulting for him from the contract.

- Package duration: the package (trip + stay) includes a fixed number of days. These prices are calculated on an all-inclusive basis and are based on a certain number of nights. Therefore, in the event of air or land transport delays, the first and/or last day may be shortened by a late arrival or an early departure, and no refund will be made.

- Accommodation: the Customer must send DÉESSE VOYAGES a written list of the names of all participants in the Event, together with a breakdown of accommodation in the form of a table, no later than 30 days before the scheduled arrival date. Booked accommodation is made available from 4 pm on the day of arrival, and must be vacated by 10 am on the day of departure. The customer is responsible for organizing the allocation of accommodation, including any resulting sharing of accommodation.

- Activities: the final number of participants must be received at least 30 days before the event.

3- Prices and terms of payment

3.1- Prices

The price corresponding to the provision of services relating to the Event is defined in the proposal. All prices are given in Euros. Prices are per person.

Revision of prices: they have been established according to the economic data in force at the date of the contract. They may be modified after signature of the booking contract in the event of increases in fuel, diesel or kerosene, or in the event of variations in the level of taxes or fees on travel services included in the contract, imposed by a third party not directly involved in the execution of the contract, including tourist taxes, landing taxes or embarkation and disembarkation taxes in ports and airports. Customers will be informed of any such increases or decreases by means of a durable medium provided by us. As these increases or decreases are provided for by law (Code du Tourisme Art L211-12), the customer cannot object to them or demand cancellation without charge. In the event of a so-called significant increase (i.e. <8%), Déesse Voyages offers a no-cost cancellation more than 30 days before departure. As for airport taxes, their amount is reconfirmed at registration and can be modified up to 20 days before departure.
In the case of air travel, the airline's specific deposit and cancellation conditions are given to the customer before registration.

3.2- Payment terms

A registration is only definitive after payment of a deposit of at least 30% of the tour price, unless otherwise specified in the contract. The balance must be paid no later than 35 days before the date of departure or arrival. Customers who have not paid the balance by this date are considered to have cancelled their trip. For orders placed less than one month before departure, full payment is required at the time of registration.

No right of withdrawal. In accordance with the provisions of articles L221-2 5° and L221-28 12°of the French Consumer Code, the customer has no right of withdrawal.

In the absence of payment, DÉESSE VOYAGES will not be able to confirm the reservation or guarantee the availability of the requested spaces, rooms, activities, visits and means of transport (non-exhaustive list) and the reservation will be cancelled.

Non-compliance with the payment schedule is considered as a total cancellation of the reservation, governed by the article "Cancellation - modification of the reservation" below.

TOURIST SERVICES

1-Cancellation - modification of reservation

1.1-Cancellation due to the organizer

We reserve the right to cancel a trip:

- in the event of an external, insurmountable and unforeseeable event (force majeure) that imposes itself on the organizer or the retailer

- in the event of an insufficient number of participants with regard to the minimum stipulated in the contract :

20 days before the start of the trip or holiday in the case of trips lasting more than 6 days;

7 days before the start of the trip or holiday in the case of trips lasting 2 to 6 days;

48H before the start of the trip or holiday in the case of trips lasting no more than 2 days

1.2-Cancellation by the customer and total modification of the group

The customer is free to cancel the booking contract at any time, subject to payment of standard cancellation charges in accordance with the provisions of article L. 211-14 of the French Tourism Code. In the event of cancellation by a participant, unless the cancellation is due to exceptional and unavoidable circumstances, occurring at or in the immediate vicinity of the destination, which have a significant impact on the execution of the contract or on the transportation of passengers to the destination, a fee will be withheld depending on the date of cancellation in relation to the departure date, and on the type of trip:

Coach trip or holiday

- More than 90 days before departure date: a fixed fee of €250 will be retained by the agency,

- From D-90 to D-60: 25% of the total cost of the trip will be retained,

- From D-59 to D-30: 50% of the total cost of the trip will be retained,

- Less than 30 days: 100% of the total amount will be retained.

In the case of air travel, specific cancellation conditions will be provided to the customer before the contract is signed, and must be stipulated in the contract.

Any request for upward modification will only be accepted subject to availability.

1.3-Cancellation and partial modification (one traveler):

Cancellation will be taken into account as soon as it is sent to DEESSE VOYAGES by registered mail with acknowledgement of receipt. The date used to define the cancellation period giving rise to penalties (booking fees, cancellation fees) will be that of the first presentation of the letter.

If the cancellation is communicated by e-mail, a personal acknowledgement of receipt confirming that the cancellation has been taken into account by DEESSE VOYAGES must be obtained as proof. No reimbursement will be made if the participant fails to arrive at the time and place indicated on the invitation or is unable to provide the documents required for check-in (air) or boarding (cruise). In the event of interruption of stay, unused services do not entitle the participant to any compensatory reimbursement.

- from contract signature to 60 days before departure: no charge

- between 59 and 45 days before departure: 25% charge per person cancelled will be retained

- between 44 and 30 days prior to departure: a 50% fee will be deducted

- between 29 and 21 days prior to departure: 75% will be charged

- from 20 days prior to departure: 100% of fees will be retained

Please note that this scale may vary depending on the trip. It will then be included in the contract. This schedule is a standard schedule. Under certain conditions, or for certain trips, a specific schedule may be applied and will be stipulated on the sales contract. It will then take precedence over this standard schedule.

2-Transfer of contract :

In accordance with article L.211-11 of the French Tourism Code, you have the option of transferring the present preliminary offer as long as it has not produced any effect and up to 7 days before departure, by notifying the agency within a reasonable period of time, to a person fulfilling the same conditions as another participant in the trip.

The transferor of the contract and the transferee are jointly and severally liable for payment of the balance of the price, as well as any fees, charges or other additional costs incurred as a result of the transfer. The organizer or retailer informs the assignor of the actual costs of the assignment, due by the assignor or assignee

LIABILITY

Déesse Voyages is fully liable for tourist services contracted under these general terms and conditions of sale.

In all cases, the agency may exonerate itself from all or part of its liability by proving that the non-performance or poor performance of the contract is attributable either to the customer, or to a third party not involved in the provision of the travel services included in the contract, and is of an unforeseeable or unavoidable nature, or to exceptional and unavoidable circumstances.

DEESSE VOYAGES cannot be held responsible for :

- in the event of changes arising from unforeseen events or their consequences, such as attacks, acts of war, political unrest, strikes, embargoes, blockades, demonstrations, riots, traffic jams, breakdowns, delays in transport connections, bad weather, injunctions by an administrative authority or public authorities;

- in the event of cancellation of certain activities on site for weather or safety reasons (sea or mountain outings, etc.);

Additional costs (meals, accommodation, transport, etc.) or losses incurred as a result of these events remain the responsibility of the participants, particularly in the case of rerouting.

Furthermore, if services (accommodation, meals, visits, etc.) cannot be provided as a result of such events, no reimbursement will be made.

Furthermore, the responsibility of DEESSE VOYAGES does not replace the individual responsibility of each participant and DEESSE VOYAGES cannot be held responsible for :

- incidents, accidents or damage resulting from careless personal initiative;

- the minor remains under the responsibility of the person with parental authority (or his/her adult companion) for the entire duration of the trip, whatever the activities undertaken (hiking, boating, quad biking, etc.);

- for damage caused during activities, visits, outings or additional or optional services provided by participants and not included in the program;

- If, at the time of departure, the participant does not present the necessary travel documents in due and proper form.

CUSTOMS AND ADMINISTRATIVE FORMALITIES

In order to provide travellers with the best possible information on the police, health and customs formalities required for entry into France and/or Europe, it is the purchaser's responsibility to inform us of the age, nationality, city of origin and any other useful information. It is the purchaser's responsibility to check the validity of the necessary identity papers, or to enquire with the relevant administrative authorities. The specific formalities applicable, in particular to minors, and the completion of the formalities incumbent upon them. We advise future travelers to visit the Francediplomatie.gouv.fr website . Nationals of foreign countries should check with the relevant authorities (consulate, embassy) in the country or countries of destination before registering, and must indicate their nationality as a comment in their application. Information provided by Déesse Voyages is subject to change. It is the traveler's responsibility to check with the relevant authorities regarding the various formalities required for the trip booked. Should the traveler be denied boarding or access to the destination country due to failure to comply with police, health or customs formalities, we cannot be held responsible under any circumstances. The traveler alone shall bear any penalties and/or fines that may be imposed as a result of non-compliance with police, health or customs regulations, as well as any consequences that may result therefrom, and we shall not be held responsible, nor shall we refund tickets or any expenses whatsoever. He will not be entitled to reimbursement by any insurance.

Please note! The surnames and first names of participants, given at registration, which appear on their travel documents (reservations, transport tickets, exchange vouchers) must correspond exactly to those appearing on their identity papers, passports, visas, etc.

LUGGAGE

Never pack valuables, fragile objects, jewelry or medicines in your luggage. When traveling by coach, or during any excursions or transfers, never leave luggage, objects or clothing inside coaches (except in the compartments provided for this purpose) or vehicles during stops. It is the passenger's responsibility to ensure that their luggage has been loaded into the coach's holds at each stop. For safety reasons, airlines prohibit the carriage of certain items in hold and cabin baggage. The list is indicated on the ticket or available from the airline concerned. In the event of a baggage claim (late delivery, theft, loss or damage of baggage), it is imperative to file a complaint with the local authorities, or to file a claim with the airline at the arrival airport in the event of a baggage claim during a flight.

In the latter case, in the absence of this document, it will be presumed that the baggage has been delivered in good condition in accordance with the conditions laid down by the airline.

All baggage must be labelled.

DEESSE VOYAGES cannot be held responsible for theft, damage or loss of baggage, objects or clothing during the journey, nor for excess baggage not taken on board by an airline.

SPECIAL REQUESTS

Any special request not covered by a supplement on the travel page, and in particular any request for special meals for medical reasons, must be notified in writing at the time of registration.

DEESSE Voyages will forward the request to its correspondents, but cannot be held responsible in any way for the consequences of non-compliance by its service providers.

PRACTICAL INFORMATION

1-Personal information

The personal information we request from you is necessary to process your request and is intended for the management of your tourist services. In order to fulfill your contract, it will be communicated to service providers involved in the execution of your trip (airlines, tourism service providers) as well as for the management of our commercial relations (purchase, reservation, cancellation, customer returns). Under no circumstances will it be passed on to third parties.

By submitting a contact form or a request for a quote, you agree that the information entered may be used for the purposes of the quote request and the ensuing commercial relationship. Other optional information collected is intended to help us get to know you better and improve the services we offer (accommodation preferences, previous trips, etc.). We also keep a record of your booking history so that we can offer you services tailored to your needs.
You have the right to access, rectify, port and delete your personal data. For more information on how we collect and process your personal data, please consult our privacy policy on our website.

2-Force majeure

In the event of force majeure as defined by article 1218 of the French Civil Code, or of exceptional and unavoidable circumstances preventing the execution of the reservation or the Event, the affected Party undertakes to inform the other Party as soon as possible.

In this case, the mutual obligations of the Parties will initially be suspended.

If the Event has not yet taken place, the reservation may be terminated by either Party in writing. If the Event is in progress, the party concerned will do its utmost to minimize the impact or propose alternative solutions where possible.

In all cases, the parties will then be released from their mutual commitments, with the exception of obligations that may survive, without any compensation being due on either side.

3-Damage

The customer is responsible for any damage he or his guests may cause during the stay. In the event of damage, the customer undertakes to restore the premises to their original state at his own expense.

4-Complaints, after-sales service

The traveler is required to inform Déesse voyages as soon as possible of any non-conformity that he/she observes during the execution of the trip or stay, in accordance with paragraph II of article L 211-16 of the French Tourism Code, so that he/she does not suffer any consequences for the continuation of his/her trip, and so that Déesse voyages can remedy the situation as soon as possible whenever possible.
In the event of a complaint on return, if no non-conformity has been reported during the trip, even though it could have helped to avoid or reduce the damage suffered, this will be taken into account and may have an influence on the amount of any refund or compensation.
We kindly ask our customers to send us their comments on their trip within 30 days of their return. In the event of a dispute, we ask our customers to send us a registered letter with acknowledgement of receipt within 30 days, clearly stating the reason for the complaint and the loss suffered. Déesse Voyages wishes to inform its customers that they have the possibility, only after having referred the matter to the Déesse voyages complaints department and in the absence of a satisfactory response or a response within 60 days, to refer the matter to the Tourism and Travel Ombudsman, whose contact details are as follows: CS 30958 - 75383 PARIS CEDEX 08 and contact details are available on the website: www.mtv.travel

5-Jurisdiction

Any dispute relating to the interpretation, performance or termination of these general terms and conditions of sale shall be governed by French law. In the event of disagreement or dispute, the parties agree to seek an amicable solution before taking any legal action.
